Tax Planning vs Tax Evasion: What Business Owners Should Know

Business owners are right to want to pay no more tax than the law requires. The line to watch is between planning within the law and evasion, which is illegal.

The problem

Advice on social media and from some intermediaries can blur the two. Schemes that promise big savings often create bigger problems later.

Lawful tax planning

  • Choosing the tax regime or business structure that suits your facts.
  • Claiming deductions and exemptions you are entitled to, with proof.
  • Timing genuine expenses and investments sensibly.
  • Keeping proper books so you can substantiate every claim.

Tax evasion

  • Hiding income or not recording sales.
  • Fake or inflated bills to claim expenses or input tax credit.
  • Claiming deductions with no real transaction behind them.
  • Showing personal spending as business cost.

What can happen

Consequences can include tax, interest, penalties, denial of credit and, in serious cases, prosecution. Once a claim is disallowed, the cost usually exceeds what was saved.

Practical checklist

  1. Be sceptical of anyone who guarantees savings.
  2. Ask what law or provision the plan relies on, and get it in writing.
  3. Make sure every claim has a real transaction and a document.
  4. Keep books current so claims can be supported.
  5. Plan early in the year, not in March.
